PURPOSE OF POLICY

This Privacy Policy (the “Policy”) describes how Design Kollective, LLC, a Utah limited liability company (“us,” “we,” or “Design Kollective”), collects, uses, and discloses your information when you visit and/or use the website located at www.designkollective.com and the services, features, content, product or applications offered therein (collectively, the “Site”). We receive information about you from various sources, including (i) if you register for the Site through your user account; (ii) your use of the Site generally; and (iii) from sellers, buyers and other third-party websites and services. When you use the Site, you are consenting to the collection, transfer, manipulation, storage, disclosure, and other uses of your information as described in this Policy.

INFORMATION YOU PROVIDE

Design Kollective will collect personal information that you provide to us, including without limitation, in connection with any registration of the Site, online surveys, and other online forms that may ask users to provide their names, email addresses, other contact information, and optional demographic information.

INFORMATION COLLECTED AUTOMATICALLY

When you visit or make use of the Site, we may also collect information about you automatically. For example, our servers automatically recognize visitors’ domain names and IP addresses. The Site may also gather “traffic data” that may be helpful for marketing purposes or for improving the services we offer.

COOKIES

We may use small pieces of data stored on your computer’s hard drive, which are commonly referred to as “cookies.” Cookies help us learn which areas of our Site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience on the Site may be diminished, and some features may not work as they were intended. We may use cookies to deliver content specific to your interests, to save your password, or for other purposes. Promotions or advertisements displayed on our Site may contain cookies. We do not have access to or control over information collected by outside advertisers on our Site.

WEB BEACONS AND TRACKING PIXELS

We may use “web beacons” that will allow us to know if you have visited a certain page or opened an email we have sent you. We may also use tracking pixels to allow us to show you better and more relevant advertising both on the Site and when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network's servers, these companies can view, edit or set their own cookies, just as if you had requested a web page from their site.

PERSONAL INFORMATION

We will not share your personal information with any third parties without your consent, except (i) as necessary to provide you with the services offered by us and by third-party vendors, consultants, sellers and/or service providers who need access to this data to carry out their work for us, (ii) to protect the rights or property of Design Kollective, (iii) to protect the personal safety of our employees, customers, or any other person, (iv) to the extent required during the negotiation of a merger, sale, financing, or acquisition, or (v) to comply with the law. We may use your personal information to verify your identity, to check your qualifications, or to follow up with transactions initiated on the Site. We may also use your contact information to inform you of any changes to the Site, or to send you additional information about Design Kollective or any third party advertisers or otherwise that we choose to partner with.

PUBLICLY AVAILABLE INFORMATION

The name you provide (not your email address) is displayed to other users when you post a comment or product review via the Site. Any comments, product reviews, or other information you post are publicly available, and any comments, product reviews, or other information that you post or submit to the Site may be redistributed through the Internet and other media channels, and may be viewed by the general public.

FINANCIAL INFORMATION

We do not currently collect or store financial information, such as your payment method (e.g., valid credit card number, type, expiration date, or other financial information). Such information is collected and stored by our third-party payment processing company (the "Payment Processor"), and the use and storage of that information is governed by the Payment Processor's applicable terms of service and privacy policy.

ANONYMOUS INFORMATION

We use anonymous information to analyze our Site traffic, but we do not examine this information for individually or personally identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer our Site, or to display content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

SALE OF INFORMATION

To accommodate changes in our business, we may sell, buy, or otherwise transfer portions of our company or other companies or assets, including the information collected through the Site. If Design Kollective or substantially all of its assets are acquired, customer information (including your information) will be one of the assets transferred to the acquirer.

SECURITY

Design Kollective takes commercially reasonable measures to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, or alteration, and we will have no liability to you or to any third party arising out of any such loss, misuse, or alteration. Design Kollective may store and process personal information in the United States and other countries.

THIRD-PARTY WEBSITES

The Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies, including without limitation, our Payment Processor.

Any information you provide in subscribing to the Site or registering or purchasing products through the Site will be transferred to the United States. By visiting the Site and submitting information, you authorize this transfer, processing and use.

The Site may include material and features that are unsuitable for children under 13 and which are not necessarily monitored. We encourage all parents to talk to their children about online safety and to monitor their children's use of the Internet.
